SmartTrip, based in Hail, Kingdom of Saudi Arabia, operates a mobile app (Android package me.shokry.smarttrip) and a website at https://safar.web-www.net through which you can browse and book heritage trips in and around Hail. These Terms of Use (the “Terms”) govern the relationship between you and SmartTrip when you use the app, the website, or any service we provide (the “Service”). Please read them carefully.

1. Acceptance of the Terms

By using the app or website, creating an account, or completing any booking with us, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, you must stop using the Service.

2. Eligibility

To use the Service and create an account, you must be eighteen (18) years of age or older and have full legal capacity to enter into a binding agreement. Minors may take part in trips only with the consent of, and under the direct responsibility and supervision of, a parent or legal guardian. When you book on behalf of others, you confirm that you are authorised to do so and that you are responsible for their compliance with these Terms.

3. Your account

• You agree to provide accurate, complete, and up-to-date information when you register (full name, email address, and phone number) and to keep it current if it changes.
• Your password is stored in hashed form (a bcrypt hash) and is never held by us in plain text. You are responsible for keeping your password confidential and not sharing your login details with anyone.
• You are responsible for all activity that takes place under your account, and you agree to notify us promptly if you suspect any unauthorised use of it.

4. Bookings

• All bookings are subject to availability and confirmation by us. A booking is not confirmed until the confirmation process is complete.
• Each trip schedule has a defined maximum capacity for the number of travellers, and bookings that exceed the available capacity cannot be accepted.
• Prices are shown in Saudi Riyals (SAR), and payment is arranged as set out in the booking details.
• Every booking is assigned a booking number that you can use to track and refer to it (for example, in the form SF-1048).

5. User responsibilities & acceptable use

When you use the Service and take part in our trips, you agree to:

• Provide accurate booking details, including the contact name, phone number, and email for the booking, the number of travellers, and any relevant notes.
• Arrive on time at the specified meeting point for the trip’s departure, as latecomers may not be able to be waited for, out of respect for other travellers’ schedules.
• Follow the guide’s safety instructions and all guidance about transport, walking, and stops throughout the trip.
• Ensure you are physically fit and healthy enough for outdoor and desert activities, and inform us in advance of any medical condition that could affect your safe participation.
• Respect other travellers, guides, and local residents, and behave courteously without causing harm, disturbance, or risk to the group.

6. Conduct at heritage & archaeological sites

Our trips visit sites of heritage, archaeological, and natural value, and you agree to help protect them for future generations. In particular, you agree to:

• Protect the antiquities and the environment and cause no damage to the sites or their surroundings.
• Not touch, deface, or write on the rock art, and not remove any artefacts, stones, or objects from their locations.
• Comply with the antiquities and heritage regulations of the Kingdom of Saudi Arabia and the instructions issued by the competent authorities at each site.
• Respect local customs, traditions, and applicable laws, and take photographs only where permitted.

7. Prohibited uses of the app

You must not use the app or website for any of the following:

• Any unlawful, misleading, fraudulent, or harmful use, or any use that breaches these Terms.
• Submitting unlawful or offensive content in the notes field or any other data fields in the Service.
• Attempting to disrupt or tamper with the Service, or gaining unauthorised access to our systems or to other users’ data.
• Impersonating any person or entity, or providing false booking or payment information.

8. Cancellations & changes

You may sometimes wish to cancel or change your booking, and you can contact us to request this using the contact details below. We also reserve the right to change trip dates or routes, or to cancel a trip, for operational, safety, environmental, or force-majeure reasons (such as weather). We will make reasonable efforts to notify you in good time and to offer a suitable alternative where possible. Any refunds are subject to the nature of the booking and the arrangements agreed at the time it was made.

9. Assumption of risk for outdoor & desert activities

Some of our trips involve activities in outdoor and desert environments that, by their nature, may carry risks, including heat, rough terrain, walking on foot, and distance from facilities. By taking part, you acknowledge that you are aware of and voluntarily accept these risks, and you are responsible for judging your ability to participate and for following safety instructions. We always recommend that you bring adequate water and suitable clothing and seek medical advice where needed.

10. Limitation of liability

The Service and the trips are provided with reasonable care. To the extent permitted by law, SmartTrip is not liable for indirect, consequential, or incidental damages, nor for any loss arising from your breach of safety instructions or of these Terms, or from circumstances beyond our reasonable control. Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under the laws of the Kingdom of Saudi Arabia.

11. Intellectual property

The “SmartTrip” brand, its logo, and the content of the app and website — including text, images, designs, and software — are owned by SmartTrip or its licensors and are protected by intellectual property laws. They may not be copied, republished, or used commercially without our prior written permission.

12. Suspension or termination of accounts

We may suspend or terminate your account, or restrict your access to the Service, if you breach these Terms or applicable laws, or where we consider it necessary to protect the safety of travellers or the security of the Service. You may also request deletion of your account and data at any time, as explained on our Delete Account & Data page.

13. Changes to these Terms

We may update these Terms from time to time to keep pace with the evolution of our services or regulatory requirements. When we make a material change, we will update the “Last updated” date at the top of this page and may notify you by appropriate means. Your continued use of the Service after the changes take effect constitutes your acceptance of them.

14. Governing law & contact

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, and the competent courts of the Kingdom have jurisdiction over any dispute arising from them. In relation to the protection of your personal data, we comply with the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia.
